Terms of Service

1. Agreement to Terms

By accessing or using the services provided by The Super Dev("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

The Super Dev provides digital agency services including but not limited to web design and development, software development, mobile app development, digital marketing, SEO, UI/UX design, cloud and DevOps consulting, and AI automation solutions. We also offer resellable products (Real Estate Management Website, Leadbot) and SaaS platforms (Masie, Barid).

3. Client Obligations

• Provide accurate and complete information required for the performance of services.
• Ensure timely review and approval of deliverables within agreed-upon timelines.
• Maintain the confidentiality of any login credentials or access we provide.
• Use our products and services in compliance with all applicable laws.

4. Intellectual Property

Upon full payment, the client receives ownership of all custom work created specifically for their project, unless otherwise agreed in writing. We retain ownership of any proprietary tools, frameworks, templates, and pre-existing code used in the delivery of services. Our resellable products are licensed, not sold — the underlying codebase remains our intellectual property.

5. Payment Terms

Payment terms are defined in individual project proposals or service agreements. Unless otherwise stated, invoices are due within 14 days of issuance. Late payments may incur a charge of 1.5% per month on the outstanding balance.

6. Resellable Products

Products such as the Real Estate Management Website and Leadbot are deployed and configured per client. Each deployment is a separate license. The client may not redistribute, resell, or sublicense the product without our written consent. Custom code modifications are covered under separate agreements.

7. SaaS Platforms

Access to our SaaS platforms (Masie, Barid) is provided on a subscription basis. Subscriptions auto-renew unless cancelled before the renewal date. We reserve the right to modify features, pricing, or availability with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law, The Super Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Termination

Either party may terminate a service agreement with 30 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. We will provide reasonable assistance in transitioning deliverables.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which The Super Dev operates, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
